Cerca de um mês depois da agressão a Colleen Shipman, foi feita a acusação formal contra Lisa Nowak, que será de tentativa de rapto. A acusação de tentativa de homicídio foi abandonada, mas a pena máxima por tentativa de rapto é, na Flórida, de prisão perpétua.Nowak declarou-se inocente de todas as acusações, e o seu advogado, Donald Lykkebak, afirma que Nowak ainda nega estas acusações, referindo que foi reconhecido que as acusações iniciais foram excessivas, mas que continuam a ser excessivas.
Fez também o seguinte comunicado à imprensa:
"After having had some time and opportunity to review the allegations originally filed by the police, the State Attorney appears to recognize that the initial charges were overreaching. Unfortunately, as demonstrated by the charges now filed, the State's current assessment still overstates the conduct. We believe that when all the facts are closely examined, this is a very different case. We previously filed not guilty pleas addressing all the charges, and you can be assured Lisa Nowak, by her plea, denies the charges and will defend vigorously.
NOTE: The [Nowak] family has asked me to express their gratitude for the continued outpouring of support from their friends and family all over the country."
